These Terms of Service govern your access to and use of LocalQuote.io, including our websites, lead capture pages, survey forms, lead delivery tools, automated follow-up systems, booking tools, and related services.
This Agreement contains a mandatory arbitration provision and a class action waiver. Please review the Dispute Resolution section before using the Platform.
By creating an account, submitting an order, signing an agreement, accessing the Platform, using the Services, or continuing to use the Services after these Terms are posted or updated, you agree to be bound by these Terms. If you are using the Services on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.
If you do not agree to these Terms, do not use the Platform or Services.
These Terms are not legal advice. You should consult your own attorney to confirm that your use of the Services complies with applicable law.
1. Definitions
“LocalQuote,” “LocalQuote.io,” “we,” “us,” or “our” means LocalQuote.io and its owners, officers, employees, contractors, affiliates, successors, and assigns.
“You” or “Customer” means the individual or business entity using the Platform or Services, including your employees, contractors, agents, representatives, and authorized users.
“Platform” means the LocalQuote.io website, lead capture system, quote request system, survey system, lead routing system, CRM workflows, AI follow-up tools, calendar booking tools, dashboards, communications tools, and related functionality made available by LocalQuote.io.
“Services” means the products and services provided by LocalQuote.io, including but not limited to lead capture pages, online estimate or quote surveys, lead delivery, automated email/SMS/voice follow-up, AI-assisted follow-up, appointment booking, CRM setup, integrations, reporting, support, and related marketing or technology services.
“Lead” means a person or business that submits information through a LocalQuote.io form, survey, funnel, website, advertisement, landing page, or other lead capture method.
“Lead Data” means information submitted by or about a Lead, including name, phone number, email address, address, ZIP code, service need, survey responses, photos, job details, preferred appointment times, consent records, and related metadata.
“Customer Data” means data, information, content, files, logos, business details, pricing information, service areas, offers, customer lists, or other materials submitted by you or on your behalf.
“Third-Party Services” means platforms, software, infrastructure, APIs, communications providers, payment processors, CRM systems, analytics systems, hosting providers, survey providers, artificial intelligence tools, and other third-party products or services used by LocalQuote.io to provide the Services. Third-Party Services may include Leadshook.com for survey generation and GoHighLevel/HighLevel for lead delivery, CRM workflows, AI follow-up, and booking.
“AI Features” means any artificial intelligence, machine learning, automated messaging, chatbot, voice assistant, content generation, lead qualification, routing, summarization, or automated response features included in or used by the Services.
“Fees” means all fees, charges, subscription payments, setup fees, usage fees, communication fees, implementation fees, lead fees, add-on fees, late fees, taxes, and other amounts owed by you under any order form, checkout page, invoice, proposal, agreement, or these Terms.
“Prohibited Uses” means the activities listed in these Terms, including the Code of Conduct section.
2. The LocalQuote.io Service
LocalQuote.io provides business-facing lead capture and follow-up technology. The Services are intended to help local service businesses collect quote or estimate requests, qualify leads, deliver Lead Data, automate follow-up, and book appointments.
LocalQuote.io is not a contractor, home service provider, insurance provider, lender, broker, legal advisor, medical provider, tax advisor, or emergency service. We do not perform the services requested by Leads. You are solely responsible for the services you provide to your own customers and prospects.
Unless expressly stated in a written agreement signed by LocalQuote.io, we do not guarantee any number of leads, appointments, sales, closed jobs, revenue, return on investment, search rankings, advertising results, or business outcomes.
3. Account Eligibility and Responsibility
You must be at least 18 years old to use the Platform or Services.
You agree to provide accurate, complete, and current information when creating an account, placing an order, or using the Services. You are responsible for keeping your account information, billing information, service area, offers, contact information, and business details accurate and up to date.
You are responsible for maintaining the confidentiality of your usernames, passwords, API keys, login credentials, and connected accounts. You are responsible for all activity that occurs under your account, whether authorized by you or not.
You agree to notify us promptly if you believe your account, login credentials, connected systems, or Customer Data have been compromised.
4. Customer Responsibilities
You are solely responsible for:
Your business operations, services, pricing, estimates, quotes, appointments, workmanship, customer service, refunds, warranties, licenses, insurance, and compliance obligations.
The accuracy, legality, and completeness of all information you provide to LocalQuote.io.
Ensuring that your offers, pricing claims, guarantees, testimonials, photos, service descriptions, and advertising claims are true, accurate, not misleading, and legally compliant.
Responding to Leads and customers in a lawful, timely, and professional manner.
Honoring appointments, quotes, offers, discounts, and representations made by you or on your behalf.
Maintaining any licenses, permits, insurance, registrations, bonds, and professional qualifications required for your business.
Complying with all laws that apply to your business, your communications, your advertising, your data practices, and your use of the Services.
You agree not to misrepresent LocalQuote.io, the Platform, or the Services. You also agree not to state or imply that LocalQuote.io performs your services, guarantees your work, endorses your business, or assumes responsibility for your customer relationships unless we have expressly agreed to that in writing.
5. Lead Data and Lead Delivery
LocalQuote.io may collect, process, organize, route, transmit, and display Lead Data for the purpose of providing the Services.
Lead Data may be delivered through email, SMS, CRM notifications, dashboards, webhooks, integrations, calendar systems, or other delivery methods. We may use Third-Party Services to collect, process, store, route, or deliver Lead Data.
You acknowledge that lead capture and lead delivery may be affected by factors outside our control, including internet outages, Third-Party Service downtime, spam filters, email deliverability issues, mobile carrier restrictions, incorrect contact information, failed integrations, user error, browser settings, ad platform changes, or changes to applicable laws or platform policies.
LocalQuote.io does not guarantee that every submitted Lead will be delivered successfully, that every Lead will be valid, that every Lead will respond, that every booked appointment will show up, or that every Lead will become a customer.
6. No Guarantee of Lead Quality or Business Results
You understand and agree that marketing, lead generation, automation, and appointment booking involve variables outside our control.
LocalQuote.io does not guarantee:
A specific number of Leads.
A specific cost per Lead.
A specific number of appointments.
A specific close rate.
A specific revenue outcome.
That Leads will be exclusive unless expressly stated in a signed written agreement.
That Leads will be accurate, ready to buy, qualified, reachable, or suitable for your business.
That AI follow-up or automated booking will produce any specific result.
Any examples, testimonials, projections, case studies, estimates, forecasts, or prior results are provided for informational purposes only and do not guarantee that you will achieve the same or similar results.
7. Third-Party Services
LocalQuote.io uses and integrates with Third-Party Services to provide the Platform and Services. These may include, without limitation, Leadshook.com for survey generation and HighLevel/GoHighLevel for CRM functionality, lead delivery, workflow automation, AI follow-up, calendar booking, SMS, email, and related communications.
Your use of the Services may require or involve Third-Party Services. You acknowledge and agree that:
Third-Party Services are not owned or controlled by LocalQuote.io.
Third-Party Services may be subject to their own terms, privacy policies, usage rules, fees, restrictions, and availability.
LocalQuote.io is not responsible for the acts, omissions, downtime, errors, security incidents, data loss, data deletion, service changes, pricing changes, policy changes, or failures of Third-Party Services.
Third-Party Services may change, suspend, restrict, or discontinue functionality at any time.
LocalQuote.io may modify the Services if a Third-Party Service changes, becomes unavailable, becomes commercially unreasonable, or creates legal, operational, security, or compliance concerns.
You authorize LocalQuote.io to transmit Customer Data and Lead Data to Third-Party Services as reasonably necessary to provide the Services.
8. Communications, Consent, TCPA, CAN-SPAM, and Telemarketing Compliance
The Services may include email, SMS, MMS, RCS, phone calls, voicemail drops, AI-assisted voice or chat, calendar reminders, automated follow-up, and other communication tools.
You are solely responsible for ensuring that all communications sent through or in connection with the Services comply with all applicable laws, rules, and industry requirements, including but not limited to:
The Telephone Consumer Protection Act (TCPA).
The Telemarketing Sales Rule (TSR).
The CAN-SPAM Act.
State telemarketing, mini-TCPA, do-not-call, automatic renewal, consumer protection, and advertising laws.
Carrier rules, 10DLC registration requirements, messaging provider policies, and acceptable use rules.
International communications laws, including GDPR and CASL, where applicable.
You represent and warrant that you have obtained all legally required consents, permissions, opt-ins, and authorizations before sending or causing any communication to be sent through the Services.
You agree not to contact, text, call, email, or otherwise communicate with any person unless you have the legal right to do so. You are responsible for maintaining records of consent and compliance.
Compliance tools, templates, opt-in language, unsubscribe tools, consent checkboxes, AI prompts, workflow settings, and other features provided by LocalQuote.io are provided for convenience only. They are not legal advice and do not guarantee legal compliance.
You are solely responsible for the content, timing, recipients, and legality of all communications sent by you, at your direction, or on your behalf through the Services.
9. Artificial Intelligence Features
The Services may include AI Features used for lead follow-up, qualification, summarization, appointment booking, suggested replies, chat, voice, text generation, or workflow automation.
AI output may be inaccurate, incomplete, outdated, offensive, misleading, or unsuitable for a particular use. You are responsible for reviewing, testing, monitoring, editing, and approving AI-generated content and AI-assisted communications before relying on them.
AI Features do not provide legal, medical, financial, tax, insurance, construction, engineering, professional, emergency, or other regulated advice. You agree not to use AI Features to make decisions that require licensed professional judgment or to make automated decisions with legal or similarly significant effects unless you have confirmed that such use is lawful and appropriate.
You agree not to use AI Features:
In any jurisdiction where such use is prohibited or restricted.
To discriminate against any person or group.
To generate false, misleading, deceptive, defamatory, hateful, harassing, sexual, violent, unlawful, or infringing content.
To impersonate a person or business without authorization.
To collect or process sensitive personal information unless legally permitted and expressly approved by LocalQuote.io in writing.
To provide professional advice that should be provided by a licensed professional.
To violate any applicable law, privacy right, intellectual property right, or Third-Party Service policy.
You must disclose to Leads and customers when legally required that they are interacting with an AI-based chatbot, voice assistant, automated system, or similar technology.
10. Privacy and Data Protection
Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
You represent and warrant that you have provided all required notices and obtained all required consents necessary to collect, use, disclose, transmit, store, and process Customer Data and Lead Data through the Services.
You are responsible for complying with all data privacy, data protection, data security, consumer protection, and marketing laws that apply to your business, including, where applicable, GDPR, CCPA/CPRA, state privacy laws, HIPAA, GLBA, PCI DSS, and similar laws.
Unless we expressly agree in writing, you may not use the Services to collect, store, process, or transmit protected health information, highly sensitive financial information, government identification numbers, children’s data, payment card data, or other sensitive personal information.
You are responsible for responding to data subject requests from your customers, Leads, and end users, including requests to access, correct, delete, restrict, or opt out of the use of personal information.
11. Data Security, Retention, and Breach Notification
LocalQuote.io uses commercially reasonable measures designed to protect the Platform and data processed through the Services. However, no system, transmission, storage method, or online service can be guaranteed to be completely secure.
You are responsible for maintaining reasonable security practices for your own accounts, devices, employees, systems, passwords, connected accounts, and exported data.
You are responsible for establishing appropriate data retention and deletion procedures for your business. LocalQuote.io may retain Customer Data and Lead Data as needed to provide the Services, comply with legal obligations, resolve disputes, enforce agreements, maintain backups, prevent fraud, and support legitimate business operations.
If you discover a security incident involving data processed through the Services, you agree to promptly notify LocalQuote.io and cooperate in good faith. You are responsible for determining and satisfying any notification obligations that apply to your own business, customers, Leads, regulators, or affected individuals, except to the extent such obligations are legally assigned to LocalQuote.io.
12. Customer Content and Materials
You retain ownership of your Customer Data, logos, trademarks, service descriptions, pricing information, offers, website copy, images, videos, and other materials you provide to LocalQuote.io.
You grant LocalQuote.io a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, modify, display, transmit, and process Customer Data and Customer Content as reasonably necessary to provide, improve, secure, and support the Services.
You represent and warrant that you own or have all rights, licenses, permissions, and consents necessary for LocalQuote.io to use the materials you provide.
You agree not to provide any materials that are unlawful, misleading, infringing, defamatory, obscene, abusive, discriminatory, deceptive, or otherwise violate these Terms.
13. Intellectual Property
The Platform, Services, software, workflows, templates, automations, surveys, forms, landing page structures, designs, documentation, training materials, processes, systems, prompts, scripts, copy frameworks, and other materials provided by LocalQuote.io are owned by LocalQuote.io or its licensors and are protected by intellectual property laws.
Subject to these Terms and payment of all applicable Fees, LocalQuote.io grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for your internal business purposes.
You may not copy, modify, resell, sublicense, reverse engineer, decompile, disassemble, scrape, reproduce, distribute, or create derivative works from the Platform or Services except as expressly allowed in writing by LocalQuote.io.
You may not remove proprietary notices, branding, tracking, code, or attribution from any LocalQuote.io materials unless we authorize you to do so in writing.
14. Feedback
If you provide feedback, suggestions, ideas, requests, or recommendations about the Platform or Services, you grant LocalQuote.io a perpetual, irrevocable, worldwide, royalty-free license to use, modify, commercialize, and incorporate that feedback without restriction or compensation to you.
15. Fees, Billing, and Payment
You agree to pay all Fees described in any order form, checkout page, invoice, proposal, signed agreement, or pricing page applicable to your purchase.
Unless otherwise stated in writing, Fees are billed in advance and are non-refundable. Subscription services automatically renew until canceled.
You authorize LocalQuote.io and its payment processors to charge your payment method for all Fees, renewals, usage charges, communication charges, taxes, and other amounts due.
You agree to keep your billing information accurate and current. If your payment method fails, we may suspend or terminate access to the Services, pause campaigns, stop lead delivery, disable automations, or require payment by another method.
You are responsible for all taxes, duties, levies, and governmental assessments associated with your purchase and use of the Services, excluding taxes based on LocalQuote.io’s income.
16. Communication and Usage Fees
Some Services may involve usage-based charges, including but not limited to SMS, MMS, phone calls, AI usage, email volume, phone numbers, call tracking, data enrichment, hosting, or Third-Party Service fees.
Unless otherwise stated in writing, you are responsible for all usage-based fees incurred through your account or in connection with your campaigns.
LocalQuote.io may change usage-based fees if Third-Party Service costs, carrier fees, AI processing fees, or infrastructure costs change.
17. Cancellation and No Refunds
You may cancel your subscription or Services as provided in your order form, checkout terms, written agreement, or account settings. If no cancellation method is stated, you must provide written notice to LocalQuote.io at the support contact we designate.
Cancellation stops future billing after the applicable billing period or commitment term. Cancellation does not relieve you of any amounts already owed.
Unless expressly stated in a signed written agreement or required by law, all Fees are non-refundable, including setup fees, subscription fees, lead fees, usage fees, implementation fees, communication fees, and fees for partially used billing periods.
If your purchase includes a minimum commitment, payment plan, or non-cancelable term, you remain responsible for all Fees due for that commitment even if you stop using the Services.
18. Service Changes, Suspension, and Termination
LocalQuote.io may modify, update, suspend, restrict, or discontinue all or part of the Platform or Services at any time.
We may suspend or terminate your access to the Services, with or without notice, if:
You fail to pay amounts owed.
You violate these Terms.
Your use creates legal, security, reputational, operational, or compliance risk.
A Third-Party Service restricts or terminates functionality needed to provide the Services.
We believe your account has been compromised or used unlawfully.
We are required to do so by law, court order, regulator, carrier, platform, or service provider.
Upon termination, your right to use the Services ends immediately. We may delete, disable, archive, or retain account data in accordance with our policies, legal obligations, and legitimate business needs.
19. Acceptable Use and Code of Conduct
You agree not to use the Platform or Services to:
Violate any applicable law, rule, regulation, court order, or Third-Party Service policy.
Send spam, unlawful marketing, unsolicited communications, or communications without legally required consent.
Contact people on do-not-call lists or people who have opted out.
Upload, transmit, or store unlawful, harmful, abusive, deceptive, defamatory, obscene, hateful, discriminatory, sexually explicit, violent, or infringing content.
Exploit, harm, or attempt to exploit or harm minors or any vulnerable person.
Impersonate any person or entity or misrepresent your affiliation with any person or entity.
Interfere with, disrupt, overload, damage, scrape, crawl, probe, scan, reverse engineer, or compromise the Platform or any connected system.
Introduce malware, viruses, worms, Trojan horses, logic bombs, or other harmful code.
Attempt to gain unauthorized access to any account, system, network, server, database, or data.
Use the Services for fraud, phishing, identity theft, deceptive advertising, fake reviews, fake leads, or other dishonest activity.
Use the Services in a way that harms LocalQuote.io, other customers, Leads, Third-Party Services, carriers, or the public.
Use the Services for adult content, illegal drugs, weapons, gambling, hate, harassment, or any other category prohibited by LocalQuote.io or applicable Third-Party Services.
Use AI Features for prohibited, deceptive, discriminatory, or unlawful purposes.
Violation of this section is a material breach of these Terms and may result in immediate suspension or termination.
20. Confidentiality
Each party may receive confidential or proprietary information from the other party. Confidential information includes non-public business, technical, financial, customer, pricing, strategy, software, workflow, campaign, and operational information.
The receiving party agrees to use confidential information only for purposes of performing under these Terms and to protect it using reasonable care. Confidential information does not include information that is public, already known without breach, independently developed, or lawfully received from a third party.
21. Disclaimers
The Platform and Services are provided on an “as is” and “as available” basis.
To the fullest extent permitted by law, LocalQuote.io disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, uninterrupted service, error-free operation, deliverability, lead quality, appointment quality, revenue performance, search ranking, advertising performance, and business results.
LocalQuote.io does not warrant that:
The Services will meet your requirements.
The Services will be uninterrupted, secure, timely, or error-free.
Leads will be valid, exclusive, qualified, reachable, or profitable.
AI Features will produce accurate, compliant, or appropriate output.
Third-Party Services will remain available, integrated, or unchanged.
Any defects or errors will be corrected.
You use the Services at your own risk.
22. Limitation of Liability
To the fullest extent permitted by law, LocalQuote.io will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, including lost profits, lost revenue, lost business, lost goodwill, lost data, replacement costs, service interruption, loss of use, failed leads, missed appointments, failed communications, or lost opportunities, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, LocalQuote.io’s total aggregate liability for any claim arising out of or relating to the Services or these Terms will not exceed the amount you paid to LocalQuote.io for the Services giving rise to the claim during the three months immediately preceding the event giving rise to liability, or one hundred dollars ($100), whichever is greater.
Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.
23. Indemnification
You agree to defend, indemnify, and hold harmless LocalQuote.io and its owners, officers, employees, contractors, affiliates, service providers, licensors, successors, and assigns from and against any claims, damages, losses, liabilities, fines, penalties, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
Your use of the Platform or Services.
Your business operations, services, customers, Leads, appointments, estimates, quotes, or transactions.
Your breach of these Terms.
Your violation of any law, regulation, third-party right, or Third-Party Service policy.
Your advertising, offers, claims, content, communications, or Customer Data.
Your failure to obtain legally required consent for calls, texts, emails, AI communications, or other outreach.
Any TCPA, CAN-SPAM, TSR, do-not-call, privacy, consumer protection, false advertising, or data protection claim related to your use of the Services.
Your misuse of AI Features or reliance on AI output.
Any dispute between you and your customers, prospects, Leads, employees, contractors, or business partners.
24. Dispute Resolution, Arbitration, and Class Action Waiver
Please read this section carefully. It affects your legal rights.
You and LocalQuote.io agree to attempt to resolve disputes informally before filing a claim. A party seeking to bring a dispute must first send written notice describing the dispute and the requested relief. The parties will attempt in good faith to resolve the dispute for at least thirty (30) days after notice is received.
Except for claims that may be brought in small claims court and claims for injunctive or equitable relief related to intellectual property, unauthorized access, or misuse of the Platform, any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding arbitration on an individual basis.
The arbitration will be administered by the American Arbitration Association under its applicable commercial arbitration rules, unless the parties agree otherwise. The arbitration will take place in Nassau County, New York, unless the arbitrator permits remote proceedings or the parties agree otherwise.
You and LocalQuote.io waive the right to a jury trial.
You and LocalQuote.io agree that disputes may be brought only on an individual basis and not as a plaintiff, claimant, or class member in any purported class, collective, consolidated, private attorney general, or representative proceeding.
The arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that party’s individual claim.
25. Governing Law and Venue
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
Subject to the arbitration provision above, any court proceeding arising out of or relating to these Terms or the Services must be brought in the state or federal courts located in Nassau County, New York, and each party consents to the personal jurisdiction and venue of those courts.
26. Changes to These Terms
We may update these Terms from time to time. Changes are effective when posted or otherwise made available unless a later date is stated.
Your continued use of the Platform or Services after updated Terms become effective means you accept the updated Terms.
27. Assignment
You may not assign or transfer these Terms or your rights under them without our prior written consent. LocalQuote.io may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, change of control, or by operation of law.
28. Force Majeure
LocalQuote.io will not be liable for any delay, failure, loss, or damage caused by events beyond our reasonable control, including acts of God, natural disasters, labor disputes, internet outages, telecommunications failures, cyberattacks, platform outages, Third-Party Service failures, carrier restrictions, government actions, war, terrorism, civil unrest, pandemics, supply disruptions, or changes in law or platform policy.

We may provide notices by email, through the Platform, by posting on our website, by invoice, or by other reasonable means.

30. Entire Agreement
These Terms, together with any applicable order form, checkout terms, proposal, invoice, privacy policy, data processing agreement, or written agreement between you and LocalQuote.io, constitute the entire agreement between you and LocalQuote.io regarding the Services.
If there is a conflict between these Terms and a signed written agreement, the signed written agreement will control only to the extent of the conflict.
31. Severability and Waiver
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
Our failure to enforce any provision of these Terms is not a waiver of our right to enforce that provision or any other provision later.
32. Survival
Sections concerning payment obligations, intellectual property, confidentiality, privacy, data protection, AI use, disclaimers, limitation of liability, indemnification, dispute resolution, governing law, and any other provisions that by their nature should survive will survive termination or expiration of these Terms.
